Service Terms & Conditions
These are Greenstar Gas, Plumbing and Heating’s Terms & Conditions. We also trade under the name: Greenstar Powerflushing, Gas, Plumbing and Heating, or Greenstar Gas, or Greenstar Gas, P&H, or Greenstar Plumbing & Heating.
1.1 They tell you:
• The rules for using our services
• What you can expect from Greenstar Gas, Plumbing and Heating
• Your rights and responsibilities
2. When These Terms Apply
2.2 The latest version always applies, and we’ll usually only make updates when we offer a new service, change how we provide a service, or have to comply with a new legal requirement.
3. What Do We Mean by “Services”?
3.1 Anything offered by Greenstar Gas, Plumbing and Heating, across all the trades we cover (Plumbing, Heating, Electrics, Drains, Bathrooms, Powerflushing, Domestic and Commercial Gas, Emergencies):
• Project Work
• Emergency Call Outs
4.1 For the purpose of these terms & conditions the following words have the following meanings:
4.2 “Us/We/Our” refers to Greenstar Gas, Plumbing and Heating.
4.3 “You” refers to you: the customer (the person or organisation for whom we agree to carry out work and/or supply or materials).
4.4 “Tradesperson/tradespeople” refers to the representative(s) appointed by Greenstar Gas, Plumbing and Heating to carry out work.
4.5 We reserve the right to refuse or decline to undertake any work. We reserve the right, at our absolute discretion, to designate the
tradesperson / tradespeople who will represent us.
5. Hourly Rate Work
5.1 The total charge to you will consist of the cost(s) of:
5.2 Labour (the amount of time spent by the tradesperson carrying out work) including all reasonable time spent in obtaining non - stocked materials, charged in accordance with our current hourly rates. If materials, supplied
by us (not exceeding the trade purchase price of materials +25% to +50% markup. You will only be charged for the time spent related to your work. All other time, I.e. lunch breaks is non chargeable.
6. Fixed Price Work
6.1 The total charge to you will be given as a firm cost (manifest errors exempted), inclusive of labour & Materials. Where a written estimate has been supplied to you, the total charge outlined in the estimate should not exceed the actual time taken by more than 20%, but may be revised in the following circumstances:
6.2 If, after submission of the estimate, you instruct us (in writing or verbally) to carry out additional work not referred to in the estimate.
6.3 If, after submission of the estimate, there is an increase in the price of materials.
6.4 If, after submission of the estimate, it is discovered that further work needs to be carried out which were not anticipated when the estimate was prepared.
6.5 If, after submission of the estimate, it is discovered that there was a manifest error when the estimate was prepared.
6.6 Requirement of a detailed Insurance Report (in addition to the estimate and invoice) will incur a nominal charge of £25.00.
6.7 We will not be under any obligation to provide an estimate to you and will only be bound by estimates given in writing to you and signed by an authorised representative. We will not be bound by any estimates given orally or in which manifest errors occur.
7. Material Collection
7.1 Collection of non-stock items is chargeable, however:
7.2 Time taken will be kept to a minimum and within reason.
7.3 If the collection time is likely to exceed 45 minutes you should be additionally informed of the circumstances.
7.4 Only one tradesperson is permitted to leave the job to collect required materials / parts.
8. Invoices & Payment
8.1 Upon your agreement for us to carry out estimated or PreBooked work, a deposit payment of 20% of the total is payable immediately for the cost of labour. We reserve the right to request full payment in advance at our discretion. We can also ask for 20% staged pavements at intervals determined by any employee / contractor working for Greenstar Gas, Plumbing and Heating.
8.2 Upon completion of work you will be invoiced, for which payment is due on receipt.
8.3 Greenstar Gas, Plumbing and Heating reserves the right to accrue and charge interest on any part of an invoice which remains unpaid at a rate of 4% over the base rate until payment is received by us in full.
8.4 You accept sole liability to make payment in full, unless you disclose when initially instructing us, to carry out work and/or supply materials that you are acting on behalf of a third party.
9.1 Where the date and/or time for work to be carried out is agreed, we will use reasonable endeavour to ensure that the tradesperson attend accordingly. We accept no liability in respect of the non-attendance or late-attendance on site of the tradesperson, or for the late or non-delivery of materials.
9.2 We will not be liable for any delay, or for the consequences of any delay, in performing any of our obligations if such delay is due to any cause beyond our reasonable control, and we will be entitled to a reasonable extension of the time for performing such obligations.
10.1 If you need to cancel (or rearrange) your booking, you must notify us (preferably by telephone) by the end of the working day before the scheduled booking. Cancellations made further in advance should also be made by telephone, and you should request written confirmation from us, so that you are not liable to be charged.
10.2 If you cancel your instructions more immediately prior to work being carried out, or materials being supplied, you will be liable for the cost of any time and materials incurred by us, together with the profit that would have been made by us, in accordance with the original instructions if the cancellation you decide to cancel your instructions if you decide to do so after 14 days that you agree to contract with us.
10.3 If your cancellation falls behind the 14 day period stated in 10.2 and you have signed and have agreed to our standard charges acceptance form then you will only be charged for what you have agreed to be charged in relation to the charges acceptance form.
11.1 Greenstar Gas, Plumbing and Heating are committed to providing professional, top quality service to every customer. If, after we have carried out the work, you are not wholly satisfied with our service(s) you must provide us with written notice within 12 months. You must allow us, and or our insurers, the opportunity to both inspect and carry out remedial work where appropriate. If you fail to notify us, as outlined above, then we will not be liable in respect of any defects in the work carried out.
12.1 For your peace of mind, we provide a 12 month guarantee on labour carried out by a Greenstar Gas, Plumbing and Heating tradesperson, in respect of faulty workmanship only. This is active from the date of completion of work, in addition to any manufacturer’s warranty/warranties.
12.2 The guarantee will become null & void if the work/appliance completed/supplied by us if:
12.2.1 Subject to misuse or negligence.
12.2.1 Repaired, modified or tampered with by anyone other than a Greenstar Gas, Plumbing and Heating tradesperson. We will accept no liability for, or guarantee suitability, materials supplied by you & will accept no liability for any consequential damage or fault.
12.3 We will not guarantee any work in respect of:
12.3.1 Blockages in waste or drainage systems
12.3.2 Any work undertaken on instruction from you and against the written or verbal advice of the tradesperson.
12.4 Work is only guaranteed in respect of work directly undertaken by us and full payment having been made. Any non-related faults arising from recommended work which has not been undertaken by us will not be guaranteed. Where we agree to carry out work on installations of inferior quality (or over ten years old) no warranty is given in respect of such work and we accept no liability in respect of the effectiveness of such work or otherwise.
13.1 We will only be liable for rectifying our own guaranteed work, and will not be held responsible for any ensuing damage or claims resulting from other work overlooked or subsequently requested and not undertaken at the time.
13.2 We will not be held liable or responsible for any damage or defect resulting from work not fully guaranteed, or where recommended work has not been carried out.
13.3 Work will not carry a guarantee where you have been notified by the tradesperson either verbally or indicated in ticked boxes or in our comments/ recommendations. We shall not be held liable for any delay, or consequences of any delay, in performing our obligations if such a delay is due to any cause beyond our reasonable control and we shall be entitled to reasonable time extensions.
13.4 We will be entitled to fully recover the costs or damages from any tradesperson whose negligence or faulty workmanship makes us liable to pay for those damages or rectification of work.
13.5 You will be solely liable for any hazardous situation in respect of the Gas Safe Regulations or any Gas Warning Notice issued by a Greenstar Gas, Plumbing and Heating tradesperson. Our tradespeople May operate under their own individual Gas Safe Registration if this applies, and as such, are solely responsible for any gas related work and subsequent liability.
14. Title to Goods
14.1 Goods supplied and delivered by us to you, or your premises, shall remain our property until paid for by you in full. Whilst goods remain our property we have the absolute authority to:
14.1.2 Retake, sell or otherwise deal with or dispose of all or any part of these goods.
14.1.3 Enter any premises, at any time and without notice, in which goods or any part thereof is installed, stored or kept, or is reasonably believed so to be.
14.1.4 Seek a court injunction to prevent you from selling, transferring or otherwise disposing of such goods.
14.2 The risk in such goods will pass to you on delivery to you. You must insure them at replacement value, and if asked you must produce evidence that they are properly insured.
15. Review Penalty
15.1 Any reviews left by you online, or claims/allegations to authorities such as Gas Safe and the Health Safety Executive against us will remain not frustrated and I manipulated.
15.2 Any addition or removal will be met with heavy penalties and by agreeing to these terms and conditions, if you frustrate or manipulate a review or make a claim which is manipulated or untrue, you accept to pay
the penalty to Greenstar Gas Plumbing and Heating for every incident of frustration and manipulation.
15.3 A ‘Penalty fee’ per incident: £150.00 to be paid within 24hours.
15.4 If left for more than 24hrs, this penalty fee, per incident, will additionally increase to an ‘additional penalty’ of a minimum +£307.66 , per 7 day week or part week thereof, and the penalty fee and additional penalty will be reinstated on each subsequent 7 days.
15.5 Additional reasonable time and labour costs may be added as and where necessary.
15.6 £307.66 is a justified approximated calculated loss per week per business review as per google analytics, and other data.
15.7 Web-links are monitored and checked periodically.
16. Gas defects
16.1 Rectification of gas defects in light of any dispute / frustration, or continuing a contract, if opened with or without our consent, a full payment will be due within 24hrs else the party will be held in breach of a null contract, frustrated contract, a disputed contract or a current continuing contract and liability will be increased to no more than +£350 within another 24hrs.
16.2 If this amount is not paid, payment will increase to a further additional +£350 daily up to a maximum of 1 week.
16.3 Outstanding amounts will need to be paid in full, before any works have commenced. Failure to make this payment within the agreed timeframe, and the liability will be increased to an additional +£350 for every week that the amount is not paid.
17.1 Complaints will be looked into, on a case by case basis, and reasonable care to resolve any issues will be taken seriously and will be
met with due care and attention.
18.1 Any works imposed or not agreed upon, will be based as under duress, no liability for works will be given, and any potential past claims, present claims, future claims, spurious claims, review claims / review additions, review retractions, insurance claims against any inferred or tacitly agreed works or claims against any works will be deemed invalid,
and subject to an additional initial diagnosis and analysis fee submission and full payment without notice to yourself for 2x £55 per 2 engineers to cover our costs for each and every separate incident attended as any
incident occurs, foreseen or otherwise.
18.2 Each days work will be paid up front, before works commence, at a cost of £350 per day per person. Upon completion of an 8-10hour work day, you will be issued a paid invoice, and this may be emailed to you.
19.1 Also, any claims that are not substantiated or refuted by a court OR
Gas Safe Register inspector, Health and Safety executive employee, any organisation, or any other body, will be met with a maximum fee penalty of up to £2000 to cover our loses or potential loss, 50% payable within 14days, and subsequent amount paid over 52 weeks.
19.2 If this is not paid within the said timeframe, this amount will be increased additionally by £350 per week to a maximum of £100,000, and a claim for compensation will be made by the appropriate agencies.
20.1 These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by a duly authorised representative and you.
20.2 Our terms and conditions will prevail over any terms and conditions used by you or contained, set out or referred to in any documentation sent to us by you.
20.3 By entering into a contract with us you agree irrevocably to waive the application of any of these terms and conditions.
20.4 These terms and conditions, and all contracts awarded between us and you, shall be governed and construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Law.
